A famous case is that of Atlanta model Lashawna Threatt who died when she was engaged in horseplay with a friend following her 30th birthday party in an Atlanta hotel. The two women leaned onto a windowpane, which shattered from the pressure. Both women fell out of the 10th floor hotel room. Lashawna died when she landed on an adjacent sunroof. What Building Codes Determine Whether Windows Are Safe Or Not?

Property owners bear a significant responsibility when it comes to ensuring windows are safe for building occupants. Local, state and even international building codes may be applicable.

The International Building Code (which has been adopted by the state of Georgia) requires exterior wall windows placed within 3 feet of the floor to have some type of safety device if the window would otherwise allow an object 4 inches or wider to pass through.

If a window is not constructed according to proper safety codes, building owners could be liable.

Are Some Windows More Dangerous Than Others?

Some cases involve a type of glass known as annealed glass, which is known to be more prone to breakage and shattering than tempered safety glass. Sometimes, older hotels have windows that don’t meet current building codes but are grandfathered in. These windows can still be made safer with seals, rails, and locks. Failure to do so resulting in injury can be grounds to assert negligence and liability. Even if windows do meet building codes, a property owner can still be held legally responsible if evidence shows they failed to use ordinary care in keeping the site and its surroundings safe.

What is the Precedent for Window Fall Civil Claims?

There have been numerous successful window fall lawsuits filed against property owners, property managers, window manufacturers, window installers, and window repair companies.

Some examples of window fall injuries sustained in Georgia:

  • In 2015, a college quarterback from Mississippi was injured after falling 15 feet through a hotel window in Atlanta, suffering multiple cuts and bruises.
  • In 2017, a 2-year-old girl incredibly managed to avoid serious injuries despite falling out of a three-story window at her apartment complex in DeKalb County. A former resident told a local television station that he wasn’t surprised by the incident, given that the windows are situated on the floor. “It would be easy for anyone to fall out.”
  • In 2018, jurors ordered a Georgia window manufacturer and installer to pay $18 million to the family and estate of a man who died in 2015 after falling from a third-story office building in Gwinnett County. Expert window testimony indicated that whether the man put slight pressure on the window or simply lost his balance, the window should have held – but for the reportedly negligent manner in which it was installed.

What Types of Claims Can Be Filed in Window Fall Injury Cases?

Window fall cases usually involve larger buildings, such as apartments, condominiums, hotels, and office buildings. Most claims are going to be based on allegations of failure to maintain the property in a reasonably safe condition. These are known as premises liability claims. You can pursue such claims against homeowners, landlords, building owners, and businesses that rent the space.

In Georgia, property owners – particularly those who use their property as a means of profit – have a responsibility to lawful guests. The extent of that duty depends on the guest’s purpose for being there.

Invitees are individuals invited on site by the owner for a lawful purpose. Most common scenario would be a customer in a store or a guest at a hotel. Per O.C.G.A. 51-3-1, these individuals are owed the highest duty of care. Property owners are expected to exercise ordinary care in keeping the site and ingress/egress points reasonably safe for invitees. They’re also responsible for routinely inspecting the site for potential defects that might negatively impact the safety of invitees. Owners of hotels, resorts, apartment complexes, etc. are examples of entities that might be liable in a window fall case involving an invitee.

Then we have licensees. These are social guests or folks who are on site lawfully, but not for the financial benefit of the owner. In these cases, property owners aren’t expected to routinely inspect the site for danger, but they are expected to address any dangerous, stagnant condition that could cause harm to guests. Premises liability claims involving licensees may be filed against homeowners, condominium associations, landlords, etc. It needs to be shown that the dangerous condition of the window was something about which the property owner knew or should have known.

Another type of claim could potentially be filed against a window manufacturer or installer.  These would be claims for product liability or negligence. Some courts have extended strict liability to manufacturers of component parts installed in mass-produced homes during construction (which would include windows). The strict liability doctrine allowed under Georgia’s product liability law allows a person to sue the manufacturer, distributor, or retailer without proving negligence, and instead showing that the marketed product caused them harm.
